1. About these terms
These Terms of Service (“Terms”) govern your use of the India site of the NextNeural marketing website at nextneural.ai/in (the “Website”), including its pages, forms, content, blog, events information, templates and agent listings, and the voice AI demos offered on it. By using the Website you agree to these Terms. If you do not agree, please do not use the Website. These Terms are an electronic record under the Information Technology Act, 2000 and do not require any physical or digital signature.
These Terms do not cover the NextNeural platform. Using the NextNeural CRM and the other NextNeural products and services (the “Platform”) is governed by separate terms that you must accept when you sign in or onboard. If there is a conflict, those platform terms control your use of the Platform, and these Terms control your use of the Website. Visitors outside India use the global site (nextneural.ai), which is operated by Supercraft Inc. under its own terms.
2. Who may use the Website
The Website is intended for businesses and business professionals. You must be at least 18 and competent to contract under the Indian Contract Act, 1872. If you use the Website on behalf of a company, you confirm that you are authorized to bind it, and “you” includes that company.
3. Using the Website
You agree to use the Website lawfully and in line with these Terms. You will not:
- break any law or infringe anyone’s rights;
- submit false, misleading or someone else’s details in a form, or impersonate anyone;
- attempt to gain unauthorized access to the Website, our systems or other users’ data, or probe, scan or test their security without our written permission;
- interfere with or overload the Website, including through bots, scrapers, crawlers or automated requests that bypass our controls (such as rate limits or Cloudflare Turnstile), other than ordinary search-engine indexing;
- introduce malware or harmful code;
- copy, reverse-engineer or extract the source code, models, prompts or data behind the Website or demos, or use them to build a competing product;
- use the Website, or output from a demo, to harass, defame, deceive or send unsolicited bulk messages, or to host, display or transmit any content that is unlawful or prohibited under Indian law; or
- use the Website for any purpose that is unlawful, harmful or not intended by these Terms.
We may suspend or limit access, remove content, or block an IP address or account if we reasonably think you have broken these Terms or put the Website or others at risk.
4. Forms, enquiries and communications
When you submit a form (for example contact, book a call, demo request, newsletter or event alerts) you agree that the details you give are accurate and that we may contact you about your request. Newsletters and event alerts are sent only if you subscribe, and you can unsubscribe at any time. A form submission or demo request does not create a contract for any product or service. Any commercial relationship starts only when we both sign an order form or agreement, or when you accept the platform terms. How we handle your personal data is described in our Privacy Policy.
5. Voice AI demos
The Website offers live voice AI demos. By using one, you also agree to the following.
- Recording. Demo calls are recorded and transcribed. We ask for your agreement before the demo starts, and the demo is not available if you do not agree. Recordings and transcripts are kept for 6 months and are not used to train AI models. See our Privacy Policy for details.
- Demo only. Demos are for evaluating NextNeural. They are not production services and may be limited, changed, interrupted or withdrawn at any time. We may limit how often or how long you can use them.
- AI-generated responses. Responses are generated by artificial intelligence and may be inaccurate, incomplete or inappropriate. They are not professional (legal, financial, medical or other) advice, and you should not rely on them for any decision.
- No sensitive information. Do not share sensitive information in a demo, such as payment card or bank account numbers, health information, or government ID numbers such as Aadhaar or PAN. Do not use a demo to record or call other people without their consent.
- Your conduct. Do not use a demo to generate unlawful, abusive or deceptive content, or to impersonate a person.
6. Intellectual property
The Website and everything on it, including text, graphics, logos, designs, software, templates, agents, demo voices and models, the NextNeural name and marks, and the selection and arrangement of content, are owned by Superstellar, Supercraft Inc. or their licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to view the Website and download or print copies of its content for your own internal business evaluation of NextNeural. You may not otherwise copy, modify, distribute, sell or create derivative works from the Website without our written permission. All rights not expressly granted are reserved.
Blog posts, case studies and other content are provided for general information. Customer names and logos on the Website are used with their permission or under applicable law and remain the property of their owners.
7. What you send us
You keep ownership of anything you send us through the Website (such as form messages). You give us a worldwide, non-exclusive, royalty-free licence to use it to respond to you, provide the demo or service you asked for, and operate and secure the Website, as described in our Privacy Policy. If you send us feedback, ideas or suggestions about NextNeural, we may use them freely without obligation or payment to you. You are responsible for what you submit and must have the right to submit it.
8. Third-party links and services
The Website may link to or embed third-party sites, content and services (for example LinkedIn, video, scheduling, analytics and advertising services). We do not control them and are not responsible for their content, availability or practices. Your use of them is at your own risk and subject to their terms.
9. Disclaimers
The Website, its content and the demos are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, availability and uninterrupted or error-free operation. We do not guarantee that the Website will be secure or free of errors or harmful components, that demo output will be accurate, or that any result described on the Website (including customer case studies and statistics) will be achieved by you.
10. Limitation of liability
To the fullest extent permitted by law:
- Superstellar, its affiliates (including Supercraft Inc.), and their directors, officers, employees and suppliers will not be liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, data, goodwill or business opportunity, arising from or related to your use of, or inability to use, the Website or the demos, even if advised of the possibility; and
- our total liability for all claims relating to the Website and the demos will not exceed INR 10,000.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud, wilful misconduct or death or personal injury caused by negligence. The Platform’s liability terms are in the platform terms.
11. Indemnity
You will defend, indemnify and hold harmless Superstellar, its affiliates and their personnel from claims, losses, liabilities and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Website or demos, or your violation of any law or third-party right.
12. Suspension and termination
You may stop using the Website at any time. We may suspend, restrict or end your access, or change or discontinue the Website or any feature, at any time, with or without notice. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity and governing law) survive termination.
13. Privacy
Our Privacy Policy explains how we process personal data through the Website, including cookies, advertising and analytics, voice demo recordings, and your rights and choices under the Digital Personal Data Protection Act, 2023. It forms part of these Terms.
14. Changes to the Website and these Terms
We may update the Website and these Terms from time to time. We will post the updated Terms with a new “Last updated” date; if the changes are material we will give additional notice, such as a banner on the Website. Changes apply from the date posted. Your continued use after that means you accept the updated Terms. If you do not agree, please stop using the Website.
15. Governing law and disputes
These Terms and any dispute arising out of or relating to them or the Website are governed by the laws of India. Before filing a claim, you agree to contact us at [email protected] and try in good faith to resolve the dispute informally for 30 days. If it is not resolved, the courts at New Delhi have exclusive jurisdiction, except that either of us may seek injunctive relief to protect intellectual property or confidential information in any competent court.
16. Grievances
For any complaint about the Website, its content or these Terms, contact our Grievance Officer at [email protected] or +91 80 3133 5933. We will acknowledge your complaint within 7 days and aim to resolve it within the period prescribed by law. Privacy and personal data complaints are handled as described in our Privacy Policy.
17. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Website. They do not replace any separate written agreement, order form or platform terms between you and us.
- Severability. If a provision is found unenforceable, it will be limited to the minimum extent necessary and the rest stays in effect.
- No waiver. Failing to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.
- Electronic communications. You agree to receive notices from us electronically, including by posting on the Website or by email.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
- Third-party beneficiaries. Our affiliates and personnel may enforce Sections 9 to 11. Otherwise, no one else has rights under these Terms.
